VENDOR : TERMS + CONDITIONS

Welcome to Haute Handmade Pop Up Markets!

We're proud to curate thoughtfully organized markets featuring local artists, makers, designers, and small businesses. To create a successful experience for everyone, we ask all participating vendors to review and agree to the following policies.

These terms apply to all Haute Handmade Pop Up Market events unless otherwise specified in writing.

1. Vendor Agreement

By confirming participation in a Haute Handmade Pop Up Market and expressly accepting these terms, the Artist/Vendor agrees to sell only the products, artwork, or merchandise specified in their approved application and to abide by these Terms & Conditions. Any changes to the approved products or merchandise must be authorized by market management.

2. Booth Fees & Payment

All booth fees are non-refundable, except as expressly provided in these Terms & Conditions. Payment is due by the date specified on the invoice. Failure to pay by the deadline may result in cancellation of the vendor's reservation and release of the booth space.

Vendors who confirm participation and expressly agree to these terms remain responsible for applicable cancellation fees, regardless of payment status.

3. Vendor Cancellations

All cancellations must be submitted in writing to Haute Handmade Pop Up Market.

14 or More Days Before the Event: Vendors who cancel at least 14 days before the event's scheduled start time may transfer 100% of their paid booth fee toward a future Haute Handmade Pop Up Market. No cash refunds will be issued. Vendors with unpaid invoices who cancel within this timeframe will have their invoices canceled without penalty.

Less Than 14 Days Before the Event: No refunds, credits, or transfers will be issued. The full booth fee remains due and payable, regardless of payment status, provided the vendor previously agreed to these terms.

No-Shows: Vendors who fail to attend without prior notice forfeit their booth fee and remain responsible for any unpaid balance under the agreed terms.

4. Event Credits & Transfers

Credits issued for eligible cancellations are valid for 12 months from the original cancellation date and may be transferred to a future market one time only. All credits are subject to application approval and booth availability.

Credits have no cash value, may not be refunded, and may not be transferred to another vendor or business without prior written approval. Any unused credit expires after 12 months.

5. Outstanding Balances & Future Participation

Vendors with unpaid booth fees resulting from late cancellations or no-shows must pay their outstanding balance in full before being eligible to participate in future Haute Handmade Pop Up Markets.

Haute Handmade reserves the right to decline future applications from vendors with unpaid balances, repeated cancellations, or a history of failing to meet payment deadlines.

6. Event Cancellation, Postponement & Weather

Haute Handmade Pop Up Markets are generally held rain or shine. Vendors are expected to participate during ordinary or unfavorable weather conditions unless market management officially cancels or postpones the event.

If an event must be canceled or postponed by Haute Handmade due to severe Kansas weather or other circumstances beyond the organizer's reasonable control, vendors will receive a credit equal to their paid booth fee toward a future Haute Handmade Pop Up Market.

Vendors who independently choose not to participate due to weather are subject to the standard vendor cancellation policy.

7. Booth Assignments & Transfers

All booth spaces are assigned at the discretion of Haute Handmade Pop Up Market. Vendors may not sell, share, reassign, or transfer their reserved booth space to another vendor or business without prior written approval.

Market management reserves the right to adjust booth assignments or event layouts as reasonably necessary.

8. Setup, Attendance & Early Departure

Vendors must arrive, unload, and complete setup according to the instructions and schedule provided by market management.

Vendors are expected to remain open and operational for the full advertised event hours. Late arrivals, early departures, or failure to attend without prior approval may affect eligibility for future markets.

9. Vendor Conduct & Compliance

Vendors are responsible for maintaining a safe, clean, and professional booth space and complying with all applicable laws, permits, venue requirements, and event rules.

Haute Handmade reserves the right to remove or decline participation by vendors who engage in unsafe, disruptive, inappropriate, or unprofessional conduct or fail to comply with event policies. Removal for a material violation of these terms may result in forfeiture of the booth fee, to the extent permitted by law.

10. Liability & Indemnification

The Artist/Vendor agrees to indemnify and hold harmless Haute Handmade Pop Up Market, LLC, the applicable event venue (including Brick & Mortar Venue when applicable), and their respective representatives from third-party claims, damages, losses, or liabilities arising from the vendor's participation, presence, products, or activities at the event, to the extent caused by the vendor's acts or omissions and permitted by law.

Vendors are responsible for their own merchandise, equipment, displays, and personal property.

11. Exceptions & Management Discretion

Haute Handmade reserves the right to consider exceptions to these policies on a case-by-case basis, including documented emergencies or extraordinary circumstances.

Any exception must be approved in writing by market management. Granting an exception in one instance does not obligate Haute Handmade to grant exceptions in the future.

12. Acknowledgment & Acceptance of Terms

By confirming participation and expressly accepting these Terms & Conditions, the Artist/Vendor agrees to all policies outlined above, including payment obligations, cancellation deadlines, and outstanding balance requirements.

Payment of an invoice further constitutes the Artist/Vendor's acknowledgment and acceptance of these Terms & Conditions and serves as electronic confirmation of their agreement.

By submitting payment, the Artist/Vendor confirms that they have reviewed, understood, and agreed to the Terms & Conditions stated above.
